Article 1 – Definition and conditions of the competition

The GENERATION company GUNPLA with capital of 5000 Euros is registered in the PARIS trade and companies register under number 85142700500026 with its head office at 6 place du 25 Aout 1944, 75014 Paris

Paris, is organizing a competition as part of an Internet marketing operation, intended to promote the website www.riseofgunpla. Com.

• The GENERATION company GUNPLA is also hereinafter referred to as: “the Organizer, the

Organizing Company, the Organizers, the Professional”.

• The “Participant” in the competition is also referred to below as “the Participant, User, Contributor, Player”.
• The “Winner” of the draw is also hereinafter referred to as “the Winner”.
  

Article 2 - Conditions of participation

This game is open to any natural person, of legal age, residing in mainland France and Europe, with an Internet connection after acceptance of the conditions of participation in accordance with the Data Protection Act.

Only one entry per natural person is accepted throughout the duration of the Competition.

Members of the GENERATION company staff are excluded from any participation in the competition. GUNPLA as well as members of their family.

Article 3 - Competition dates

– start date of the competition: December 1, 2022 at 0 a.m.

– end date of the competition: December 31, 2022 at 23:59 p.m.

– draw date: January 06, 2023

– date of designation of the Winner: January 07, 2023

Article 4 – Conditions of participation

4.1) Conditions for submitting an application

In order for participation to be validated by the Organizer, there are two steps that must be followed, the participant must:

1. a) Connect to the website www.riseofgunpla.com
2. b) Register by creating an account by clicking on the “my account” tab located at the top right of the home page then entering your contact information as well as the code received in the dedicated email
3. c) place an order of at least €50 (shipping costs included) in order to win a chance to draw.
   d) each level of €50 exceeded will give an additional chance in the draw.
   e) Other tickets can be won in various ways (on social networks, the Advent calendar)
   

4.2) Guarantees and liability on the validity of applications

GENERATION GUNPLA reserves the right to cancel, terminate or modify this operation if it does not take place as agreed: any virus, bug, violation, unauthorized intervention, fraud, action of a competitor, technical problem or other cause outside the GENERATION control GUNPLA alters and affects the administration, security, fairness, integrity, or conduct of GENERATION GUNPLA.

In general, the Participants guarantee the Organizers of this competition against any recourse, actions or claims that could be filed, in any capacity whatsoever, by any third party, under all the guarantees and commitments made.

Any incomplete or erroneous participation will be rejected, without the Organizer being held liable. Any false statement by a participant will result in their exclusion from the competition without the Organizer being held liable.

Thus, the Organizing Company reserves the right without reservation to moderate a posteriori and not to validate, or even exclude or delete from the competition, any participant who does not respect one of the conditions of these regulations.

4.3) Draw terms

Article 5 – Prizes/prizes

5.1) Commercial value of the prizes:

The lot is offered by GENERATION GUNPLA and constitutes in this sense “endowments”.

The lot therefore has no commercial value.

The prize offered cannot give rise to any dispute as to their nature nor to the provision of compensation of any kind whatsoever.

The participant drawn at random will be designated the winner by those responsible for the competition.

The GENERATION company GUNPLA reserves the right to change the allocation without notice. If this were the case, the value of the lot would be equivalent to or greater than the replaced product.

Consideration in check or cash for gifts cannot be offered.

5.2) Conditions of recovery and use

As provided for in Article 6, the Winner must contact the Professional concerned in the prize and comply with the terms of use defined in Article 5.1.

Article 6 – Conditions for awarding prizes

Up to 11 prizes will be made by drawing lots depending on the number of levels.

The Winner will then be asked to provide their precise contact details: name, first name, date of birth, address, city, postal code, country, telephone number, email address by email to: riseofgunpla@ Gmail.com

If the information provided by the participant is incomplete and/or does not allow them to be informed of their win, they will lose their status as Winner and will not be able to make any claim.

The Organizer cannot be held responsible in the event of technical deficiencies regarding this electronic notification of winnings. Without communication of this information from the Winner within 8 days, he will lose his status as Winner.

Official and personalized notifications of the allocation of prizes to the Winner with the description and withdrawal methods will be sent to them by return email to the email address they have indicated.

Article 7 – Nominative and personal data

The Players authorize in advance by the sole fact of their participation, which the Organizers freely use for advertising or promotional purposes whatever the medium, all personal information communicated on their behalf and on all media.

The personal data collected about you are mandatory and necessary for the processing of your participation in the game. They are intended for the Organizers, or subcontractors and/or service providers for management purposes.

In accordance with current regulations, the information collected is intended exclusively for the Organizers and will not be sold or transferred to third parties in any way whatsoever.

The information communicated by the participant is intended for the use of GENERATION GUNPLA as part of access to its service in accordance with the general conditions of sale and as part of the management of this game.

Article 8 – Responsibilities and rights

Organizers :

• Reserve the right to modify, extend, shorten, limit winnings or cancel this game in the event of force majeure as defined by case law. Consequently, their liability cannot be incurred as a result.
• Cannot be held responsible for the fraudulent use of a Participant's connection or prize allocation rights.
• Disclaim all responsibility in the event of a malfunction of the internet network, telephone lines, reception equipment preventing the smooth running of the game. In addition, their liability cannot under any circumstances be held responsible for routing problems or loss of e-mail or postal.
• Disclaim all liability in the event of technical failure, anomaly, hardware and software of any nature (virus, bug, etc.) caused on the Participant's system, their computer equipment and the data stored there and the consequences that may result from this on their activity personal, professional or commercial.

Article 9 – Exclusion conditions

Participation in these games implies full acceptance of the terms set out in these regulations without any reservation or prior condition from the Participant, non-compliance with said regulations, leading to exclusion from the competition, pure and simple nullity of their participation and the allocation of prizes.

It can be sent on simple request.

The costs of sending this request will be reimbursed on the basis of a postage stamp at the slow rate in force in France.
Only one refund will be sent per household (same name, same address) and shipment. Upon simple written request to the same addresses as article 6, the necessary internet connection costs, reading the rules and participating in the draw will be reimbursed at the local peak hour rate in force (connection costs reimbursed on the basis of 5 minutes of RTC connection). The reimbursement request must be accompanied by proof from the telecom operator or internet service provider, mentioning the date, time and duration of the call.
It is understood that there is no refund if participation is made as part of an unlimited package (ADSL, Cable or other, etc.).

Reimbursement of sums (stamp or connection) will be made by bank transfer or check at the choice of the Organizing Company, after provision by the complainant of all the information necessary for the operation.

Article 11 – Competent courts

These regulations are subject to French law.

The parties shall endeavor to resolve amicably any dispute arising from the interpretation or execution of these regulations. If the disagreement persists, it will be submitted to the competent courts.

The Participant acknowledges having read these regulations, accepts them without reservation and complies with them.
